A senior employee at a Frankfurt-based bank was dismissed with immediate effect following a restructuring announcement, without the consultation process explicitly required under the employee's own contract and the bank's internal policy. The employee sought both compensation and, more importantly to them, a settlement that did not misrepresent the circumstances of their departure.
We built the claim around the bank's own documented policy rather than a general wrongful dismissal argument, making it considerably harder for the bank to dispute that its own required process had simply not been followed. Settlement terms were negotiated to include an agreed reference alongside the financial compensation, addressing the employee's reputational concern directly rather than treating it as secondary to the monetary outcome.
The matter settled with compensation exceeding the bank's initial offer by a significant margin, alongside the agreed reference the employee had specifically asked for.
