A Landmark DIFC Courts Ruling Strengthens Cross-Border Enforcement

A Landmark DIFC Courts Ruling Strengthens Cross-Border Enforcement
A recent DIFC Courts decision has reinforced the enforceability of judgments and arbitral awards against assets held across the wider Gulf region, an outcome our arbitration and cross-border teams have been watching closely given how often DIFC-seated arbitration features in the transactions we structure between Malta and the UAE.
For clients, the practical takeaway is straightforward: a properly seated DIFC arbitration clause, backed by DIFC-LCIA rules, continues to offer genuine, demonstrable enforcement value rather than a theoretical one. That matters directly to how we advise on governing law and dispute resolution forum selection for new cross-border transactions, a decision we treat as substantive negotiation rather than late-stage boilerplate.
"Enforceability is the whole point of choosing a forum in the first place," said Adv. Jonathan Wayne, who leads much of the firm's arbitration and dispute resolution work. "A dispute resolution clause is only as good as a party's actual ability to collect on the result, and this ruling gives our clients real confidence in a structure many of them already rely on."
