A Gulf-based developer engaged us after a major contractor disputed a completion certificate on a large construction project, triggering delay penalties the contractor argued should not apply. The contract's arbitration clause pointed to ICC rules, with the developer's commercial reputation and a significant sum in penalties both at stake.
We built the developer's case around the project's own contemporaneous records — site diaries, correspondence, and inspection reports — rather than relying on expert reconstruction after the fact, and coordinated closely with the developer's technical team to keep the tribunal focused on the actual sequence of delay events rather than a battle of competing experts.
The tribunal found substantially in the developer's favour on the delay penalty question, awarding costs in the developer's favour as well.
