A technology company holding an EU-registered patent discovered a competitor selling a product line that appeared to replicate the patented mechanism closely enough to raise a genuine infringement question, in a market where the client's revenue from that mechanism was significant.
We coordinated a technical infringement analysis with the client's own engineers before issuing a formal notice, deliberately avoiding an aggressive first move that could have pushed the competitor toward a drawn-out dispute rather than a commercial resolution, consistent with our general preference for resolving matters before they reach a courtroom wherever possible.
The competitor agreed to cease sales of the infringing product line and entered a licensing arrangement with the client rather than proceeding to litigation.
